Data Protection information pursuant Art. 13 GDPR (General Data Protection Regulation)

With the following information we will provide you with an overview of the processing of your personal data within the in accordance with the TRUMPF Finance Manager and your rights under data protection law.

Which data are processed in detail and how they are used depends largely on the services requested or agreed on in each case. The following provides information on data processing that occurs on our website as well as on the TRUMPF Finance Manager platform. The following information fulfils the obligations pursuant to Art. 13 GDPR for data subjects.

2. What sources an data do we use?

TRUMPF Financial Service collects, stores and uses personal and company data exclusively in connection with the use of the TRUMPF Finance Manager for the purpose of establishing contacts between you and TRUMPF Financial Services GmbH with regards to the development of contracts for financing solutions (currently finance lease, operating lease, hire purchase and loans) and related services. Should you also request financing offers from other banks and financial service providers, i.e. the financing partners of TRUMPF Financial Services (hereinafter referred to as "financing partners"), your data will only be forwarded to the financing partners you have selected.

 

TRUMPF Financial Service will, except for the data required for the maintenance of your account and to complete the financing request, block the personal data and documents and delete them after expiry of tax and commercial regulations. Anonymised data from the inquiry will be stored for statistical purposes. These data are evaluated for statistical purposes. "Anonymous data" do not allow conclusions to be drawn about the respective individual user.

Relevant personal data are details of individual firms or contact persons (natural persons) of the users of the platform. This is the information that is provided within the context of registration with reference to a natural person.

 

3. Processing purposes and legal basis for the processing

The TRUMPF Finance Manager functions in such a way that users (companies or sole proprietors) calculate their demand for financial products as part of the procurement of capital goods online and request offers. This demand is made available exclusively for TRUMPF Financial Services in a structured form. Should you require further offers from financing partners, these requirements will only be made available to the financing partners you select.

 

TRUMPF Financial Services and if required other financial service providers will then have the opportunity to submit suitable financing solutions (hereinafter referred to as "Offers") to the User. The user can decide on an offer and the conclusion of the transaction is requested. When registering the user, details of a contact person must be provided. This information is required to establish contact between the user and TRUMPF Financial Services.

 

3.1 Pursuing legitimate interests (Art. 6 Sec. 1. f) GDPR)

We are processing your data to the extend necessary for the purposes of legitimate interests by us or a third party, e.g.:

  • to respond to and defend against legal claims and to comply with legal obligations
  • Securing IT-Safety an continuity
  • Prevention and detection of criminal offences
  • for direct marketing purposes regarding our services and products via post or email

 

3.2 Processing of data for the performance of a contract (Art. 6 Sec. 1. b) GDPR)

We are processing your data to the extend necessary to perform our financial intermediation services. Data is transferred to financial service providers for that purpose. Personal contact data are used and transferred so the parties can make contact.

 

3.3 Who will receive my data?

The transfer of data to financial partners takes only place with our permission within context of the inquiry. All recorded, request-relevant data, including the uploaded document, is forwarded. If you have uploaded documents for your inquiry, the documents are always passed on completely and unchecked. In addition to banks and financial service providers, the collected data is also made available to technical service providers who have been commissioned by us to operate the TRUMPF Finance Manager. The data is forwarded to these service providers exclusively for the purpose of processing the financing request.

 To validate a customer-specific type of financing (financing lease, operating lease, hire purchase or loan), a product finder is integrated in the TRUMPF Finance Manager. All entries and answers (e.g. number of shifts, planning of a new acquisition, etc.) made by the user in the product finder are made available to TRUMPF Financial Services and, if desired, to the financial partners to determine an individual offer. A user is not obliged to use the Product Finder and can skip the prompt at any time.

 The following personal and company-related data will be passed on:

Company name, legal form, year of foundation, address, postal code, city, function in the company, telephone number, first name, surname, e-mail address.

 

4. How long is my data stored?

If necessary, we will process and store your personal data for the duration of the account created in the TRUMPF Finance Manager. Storage beyond this period can occur up to ten years after termination of a contract due to legal retention requirements.

 

 5. Data transfer to a third country?

Personal data is only transferred to a third country (outside the EU or the European Economic Area EEA) as far as this is necessary for performance of our services (like provision to financial partner), in case of legal obligation or if you have given consent.

  

6. Your rights

In respect to your personal data, you have the right to request from us information, correction, erasure or limitation in accordance with the legal regulations. Furthermore, we provide you with your data in a structured, conventional and machine-readable format. If we use your data based on your consent, you may revoke your consent at any time.  From the time of revocation, we will no longer use your data for the agreed purpose.  If we believe to have a legitimate interest in processing your data, you may contact us and raise your objection. Irrespective thereof, you may at any time contact the responsible supervising authorities.

 

7. Automated individual decision making and profiling?

Your data will not be used within the framework of the TRUMPF Finance Manager for profile formation (scoring). No automated individual decisions are made.

 

8. Provision of our Website

You can visit our website without providing any personal information. Each time one of our website pages is accessed, the web server automatically stores only the IP address, date and time of your request, the time zone difference from Greenwich Mean Time (GMT), the content of your request (specific site), the access status/http status code, the respective quantity of data transmitted, the website from which the request is sent, the browser, the operating system and its interface, as well as the language and version of the browser software. These data are never stored specifically to your person. These access data are evaluated exclusively for the purpose of ensuring trouble-free operation of our site and to improve our services. If the IP address is to be regarded as personal, it will be deleted after 90 days at the latest, unless there are other compelling reasons to the contrary.

If you make enquiries via the contact forms on our website, we will process the data provided by you in order to be able to respond to you. Long-term storage will only take place, as far as your enquiry requires this. Otherwise, your data will be deleted at the latest after six months

 

9. Google Analytics

We use the tool Google Analytics by Google (Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA). For Europe: Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland).

Google Analytics works with text files that are stored on your device (so-called “cookies”) in order to obtain information on your website use.  Google uses this information on our behalf in order to provide us with evaluations of your website use, reports on activities on the website and further services.  The data regarding your website use, collected with the help of “cookies”, are usually transferred to the servers of Google in the USA and are stored there.  Data that may otherwise exist about you and is deposited at Google will not be combined.

Moreover, we use the masking function “anonymizeIP “. Before your IP address is transferred to the Google servers in the USA, it is shortened in the EU. Unshortened IP addresses are transferred in rare cases only and are subsequently shortened on servers in the USA.  You may avoid this processing by means of the following measures:

It is possible to set your browser so that no “cookies” are stored.  This may, however, cause our website to not function properly.  Furthermore, it is possible to prevent data collection by means of a browser add-on by Google. As an alternative to the browser add-on, e.g. if you use a smartphone and/or tablets, you can prevent data collection by Google Analytics by clicking here. This will set a cookie that prevents data collection.  If you revisit our website with a different device or browser, or if you have erased your cookies, you have to set the cookie again.

This prevents the collection of data generated by the cookie and related to your use of the website (including your IP address) and the processing of this data by Google. 

 

10. Google Adwords Remarketing

We use the AdWords Remarketing function from Google (Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA). For Europe: Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland

Google Remarketing allows us to show you only those products that really interest you when you visit websites that are part of the Google Display Network (GND).

Cookies are stored by your browser in order to recognize you when you visit GND websites. By analysing your use of the website, you will then be shown advertisements for the products you have already viewed, or which may be of interest to you.

To prevent cookies from being stored for remarketing purposes, you can adjust settings on personalized advertising at http://www.google.com/settings/ads . Alternatively, you can follow the

11. Google Adwords Conversion-Tracking

We use the AdWords conversion tracking function from Google (Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA).

Google Conversion Tracking allows us to track what happens after a user accesses our ad. For example, to find out whether a product is being purchased or to subscribe to our newsletter. By clicking on our Google ad, a cookie is stored on your device to enable this function. There is no personal reference.

To prevent cookies from being saved for conversion tracking, you can adjust the settings in your browser.
